Here’s the process in a nutshell:
We start with a conversation. Help me understand your problem. All business problems are different. The better I understand your issues, the more helpful I can be.
Next, I have a conversation with your business partner(s). They have a point of view as well. I need to understand the dynamics. Because I am not a lawyer, nobody has to feel threatened or defensive. I don’t look for fault, I look for ways to preserve the business (that’s first priority!) and bring a peaceful solution to your conflict.
Once I’ve heard from all parties, we sit down for a meeting to discuss proposals for resolving the problems. No actions are imposed on anyone. My job is to find mutually agreeable solutions. I will give you lots of ideas to resolve the problem once and for all. When we’ve reached agreement, we draft a resolution for the company’s records or have the company attorney (or a business attorney) draft any necessary documents. Sometimes the problems can be resolved by drafting a new partnership agreement. We can work out acceptable terms for a buyout if that’s the best option.
Once there is agreement on a course of action, I help you implement the solution and keep things calm. I can help coordinate the outcome with your attorney and/or CPA.
Remember, I am on the side of the business. I want your business to succeed so that you succeed. A business torn apart by dispute is of no value to anyone.
